JAM Recruitment Limited (“JAM”, “we”, “us” or “our”) is a recruitment agency and employment business. For the purposes of UK data protection law, we are the controller of the personal data covered by this Privacy Notice.

2. This Privacy Notice applies to:
  • candidates for permanent, contract, temporary, interim and fixed-term roles
  • contractors and temporary workers we place or supply
  • client and prospective 
  • client contacts
  • supplier and service provider contacts
    visitors to our website

This notice does not apply to JAM’s employees or internal workforce, who are covered by separate internal privacy information.

3. What personal data we collect

Depending on our relationship with you, we may collect and use personal data such as: 

  • your name, contact details and address
    your CV, employment history, qualifications, training, skills and experience
  • salary or rate information, benefits expectations, notice period, availability and location preferences
  • right to work, visa and immigration information
  • interview notes, feedback, assessments and communications with you
  • references and verification information
  • records of applications, placements, assignments, timesheets, payroll and invoicing where relevant
    information about your use of our website, devices, IP address and cookie preferences

Where relevant, lawful and necessary, we may also process more sensitive information, including:

  • diversity and equal opportunities information
  • health information or reasonable adjustment requirements
  • security clearance details
    criminal convictions or offence information

We only collect this type of information where it is appropriate for the role or service, permitted by law, and supported by an appropriate legal basis or condition.

4. How we collect your personal data

We may collect your personal data:

  • directly from you when you contact us, apply for a role, send us your CV, register with us or otherwise engage with our services
  • from job boards, professional networking sites and other publicly available sources
  • from clients, referees, screening providers and compliance providers
    through referrals from other individuals
    through cookies and similar technologies when you use our website.

If we receive your personal data from a source other than you, we will provide you with the information required by law within the relevant time period.

5. Why we use your personal data

We use personal data to operate our recruitment business and provide our services. This includes:

  • identifying and contacting suitable candidates
  • assessing suitability for roles
  • matching candidates to vacancies
  • presenting candidate details to clients for specific opportunities
  • arranging interviews and managing recruitment processes
  • making placements and managing assignments
  • carrying out compliance checks, including right to work, references and other lawful screening
  • managing client, supplier and business relationships
  • maintaining our records, systems and internal administration
  • improving our website, services and communications
  • sending relevant job alerts, market updates, event invitations and other business communications where permitted.
6. Our lawful bases for processing

  • legitimate interests - for example, operating and improving our recruitment services, maintaining business relationships, and matching candidates to relevant opportunities
  • taking steps before entering into a contract - for example, progressing an application or discussing a placement
  • performance of a contract - for example, where we have entered into a contract with you or your organisation
  • legal obligation - for example, where we must carry out right to work, tax, employment, compliance or record-keeping obligations
  • consent - where we specifically ask for it and the law requires or makes consent the appropriate basis.

Where we process special category data or criminal offence data, we will only do so where we have an appropriate lawful basis and an additional condition required by law.

7. Who we share your data with

We may share your personal data where necessary and lawful with:

  • clients, hirers and end clients
  • referees and screening or compliance providers
  • IT, CRM, payroll, website, analytics and other service providers acting on our behalf
  • professional advisers, insurers, auditors and legal advisers
  • regulators, courts, law enforcement or public authorities where required
    any business purchaser or successor in connection with a merger, acquisition or reorganisation.

We do not sell your personal data.

Where you are a candidate, we will not send your details to a client for a specific opportunity without discussing that opportunity with you first.

8. International transfers

We mainly store and use personal data in the United Kingdom. Where personal data is transferred outside the UK, we will make sure appropriate safeguards are in place in accordance with data protection law.

9. How long we keep your data

We keep personal data only for as long as necessary for the purposes for which it was collected, including to meet legal, regulatory, tax, accounting and contractual requirements and to establish, exercise or defend legal claims.

As a general rule, we keep candidate data for up to 7 years from our last meaningful contact with you.

Meaningful contact may include, for example:

  • you applying for a role
  • sending us an updated CV
  • discussing current or future opportunities with us
  • otherwise actively engaging with our recruitment services

We may keep certain records for longer where the law requires this or where it is reasonably necessary for legitimate business or legal purposes.

Where deletion from backups or archive systems is not immediately possible, we will ensure the data remains securely stored and is not returned to active use except where necessary.

10. Marketing

We may send you information about roles, market updates, reports, events and services that we think may be relevant to you.

Where the law requires consent, we will ask for it. Where the law allows us to contact you without consent, we will do so only where we consider it fair, proportionate and relevant to your relationship with us.

You can opt out of marketing at any time by using the unsubscribe link in a message or by contacting data@jam-talent.com.

We may keep a limited record of your marketing preferences so that we can respect your opt-out.

11. Automated tools, profiling and AI-assisted recruitment

We may use recruitment tools and search technologies to help us organise candidate information, search for relevant skills, match candidates to roles and improve efficiency.

We do not intend to make decisions about you based solely on automated processing where that decision would have a legal or similarly significant effect on you, unless this is lawful and appropriate safeguards are in place.

12. Data security

We take appropriate technical and organisational measures to protect personal data against accidental or unlawful loss, misuse, alteration, unauthorised disclosure or access.

These measures include system security, access controls, staff training, supplier controls and internal procedures for handling personal data and security incidents.

If you are given a password or login details for any part of our website or services, you are responsible for keeping those details confidential.

Subject to applicable law, you may have the right to:

  • request access to the personal data we hold about you
  • ask us to correct inaccurate or incomplete data
  • ask us to delete your personal data in certain circumstances
  • ask us to restrict how we use your personal data in certain circumstances
